Terms & Conditions

All sales made by Cristina t/a Penny the Bee are subject to the following terms and conditions. These terms and conditions do not affect your other statutory rights as a consumer. Please read the following terms and conditions; if there is anything you do not understand in this document please feel free to contact Penny the Bee.

 

Price

 

The price for the order shall be as stated on your Order Form or email.

You agree to pay the full price to Penny the Bee in accordance with the order form/email after the details are checked and agreed by you and you have signed the Order Form.

 

Consultations

 

Consultations are by appointment only. Appointments may be made by sending an email to: info@pennythebee.com

You may also send an email to discuss any aspects of your cake requirements before making a booking.

 

Deposits

 

All cake orders require a non-refundable deposit of 50% of the total cost, which will become due once the order has been placed. For last minute orders please discuss the arrangements with Penny the Bee. 

 

Please note that all deposits are non-refundable and non-transferable.

 

All orders are deemed to have been accepted only when the deposit has been received.

Deposit may be paid by direct bank transfer to the account specified on the Order Form.

 

Final Payments

 

Final payments are due as follows:

 

a) Wedding Cake orders: the balance must be cleared 4 weeks prior to the collection/delivery date of your cake, or as otherwise stated on your Order Form, to be paid by direct bank transfer to the account specified on the invoice.

 

b) Other cake orders: at least 1 week prior the collection/delivery date of your cake, or as otherwise stated on your Order Form or email, to be paid by direct bank transfer to the account specified.

 

Non-Payments

 

Please note that, in the event that any payment is subsequently declined, the order will not be completed or released until alternative funding arrangements have been agreed and payment is made in full.

Subsequent completion of the order will be subject to availability and cannot be guaranteed.

Penny the Bee accepts no responsibility for any loss howsoever arising or for non-delivery under these circumstances. The customer will be responsible for the payment of any additional charges which have been incurred as a result of payment failure.

 

Lead Times

 

Penny the Bee requires a minimum of 3 months notice for all wedding cake orders. A minimum of 2 weeks is required for any other celebration cakes. Please note that short notice orders might be accepted, but this is entirely at Penny the Bee’s discretion and under these circumstances acceptance of orders cannot be guaranteed.

 

Alteration to orders

 

Your cake is very important to Penny the Bee. Please take the time to check your copy of the Order Form carefully and let Penny the Bee know within three days of your signing the Order Form if changes are needed, or as otherwise stated on your order form.

In the circumstances the alterations may affect the quoted fee, Penny the Bee reserves the right to adjust the final balance due accordingly.

Late changes may be accepted, but the acceptance is entirely at Penny the Bee’s discretion.

 

Collection

 

Your order may be collected at a pre-agreed time and date from our studio or from a different collection point specified by Penny the Bee.

 

Cakes that are collected by the Customer are always boxed for transportation.

A signature will be required upon collection confirming that you have received your order in good condition and as specified. Once the cake has been collected and signed for, Penny the Bee is unable to accept any liability for any interference with, or damage to, the cake thereafter.

 

Delivery

 

If requested Penny the Bee will deliver your cake to the venue at a pre-agreed time and date if within London zones 1,2,3 or as otherwise stated on your Order Form. If you have a specific delivery date and require delivery before a given time, please specify this when placing your order. Penny the Bee will do her best to accommodate your requirements. It is the Customer's responsibility to ensure that you have provided Penny the Bee with the correct delivery information, and that someone is available to take delivery of your cake. A signature will be required for the receipt of the order upon delivery.

Please be aware that delivery is not included in the price of the cake and will be charged separately, as indicated in the Order Form.

 

Once your order has been delivered and signed for, Penny the Bee is unable to accept any liability for any interference with, or damage to, your order thereafter.

 

Set up

 

Should you require your cake to be delivered, Penny the Bee will deliver and set up your cake as agreed.

It is your responsibility that you have provided Penny the Bee with the set-up details and arrangements made with the venue relating to the location and the display of your cake, which could affect the final display of your cake. Please ensure, therefore, that the display location is levelled, stable and strong enough to hold the cake.

 

Please be aware that chocolate covered cakes can melt in warm conditions.

 

For venue deliveries, once the cake has been delivered and set up by Penny the Bee, a signature will be required from your venue management confirming the cake has been received and set up in good condition.

Once the cake has been set up and signed for, Penny the Bee is unable to accept any liability for any interference with, or damage to, the cake thereafter.

 

Cancellations

 

Certain components and/or tools of your order may need to be ordered months in advance. For this reason, please find below the conditions relating to the cancellation policy regarding your order:

 

a) Wedding cake orders:

-  3 months from collection/delivery date: 50% of the total cost is required. If you have paid the 50% deposit, this will not be returned.

-  0 to 1 month from collection/delivery date: 100% of the total cost is required. Penny the Bee will issue an invoice for the balance immediately.

 

b) Other cake and sweet orders:

- 2 weeks to 1 week from collection/delivery date: 50% of the total cost is required. If you have paid the 50% deposit, this will not be returned.

- Within 1 week from cancellation/delivery date: 100% of the total cost is required. Penny the Bee will issue an invoice for the balance immediately.

 

Special terms may apply to short notice orders. These will be discussed with the Customer.

 

Every order cancellation must be made in writing.

 

Copyright

 

Please note that the copy, reproduction in any way, or use of any image, design, photography or other document or item produced by Penny the Bee is not permitted without prior written consent of Penny the Bee.

 

Publication and promotional rights

 

By signing the Customer Order Form the Customer agrees that Penny the Bee is the sole designer and owner of the final cake design. Penny the Bee reserves the right to use any image of a Customer’s cake made by Penny the Bee for royalty-free publication at a later date.

 

Designs/Sketches

 

Every ‘cake design’ is specifically tailored to fit your needs and/or for your special occasion.

All of the designs shown or given to the Customer are not to be copied or reproduced in any way without the prior written consent of Penny the Bee; sold, or passed to anyone without the prior written consent of Penny the Bee. You are kindly asked to keep them confidential.

Penny the Bee reserves the right to use or re-use all the sketches for other purposes and orders.

The Customer has no ownership rights over any cake design or sketch.

All rights in any original designs created and designed by Penny the Bee shall remain the exclusive property of Penny the Bee.

Flowers

​

In case your cake design contains real flowers, Penny the Bee will generally use fresh flowers or edible flowers if available. Please be aware that flowers are not a food product and my contain pesticides, chemicals and other contaminants. All flowers (real or artificial) and any exterior icing, which was in contact with the flowers, must be removed before serving.

When requesting fresh flowers on your cake, please be aware that they will not be suitable for people with an allergy to pollen.

 

Allergies

 

Please be aware that your order will contain allergens (such as milk, gluten, wheat, eggs, soy, peanuts, nuts and other). Also, please be aware that whilst your chosen product may not contain whole nuts or a nut product, it will be prepared in a kitchen where nut products and other allergens (such as milk, gluten, wheat, eggs, soy, peanuts) are used and it is therefore not suitable to be consumed by allergy sufferers, including airborne allergies. At present we do not provide products for specific dietary/allergy requirements. Allergy information is provided with all cake orders upon collection/delivery. You accept the responsibility to notifying your guests and any involved parties of all the information given.

 

Privacy

 

Any information provided will be kept strictly confidential and will only be used:

- To provide the service the Customer has asked Penny the Bee to provide.

- To communicate with the Customer about the service the Customer has asked Penny the Bee to provide.

- To provide the Customer with marketing and offers from Penny the Bee (where Penny the Bee has the Customer's permission to do so.)

- Your information may be disclosed to comply with law, and any tax law related matters. 

 

Any information provided will be treated in compliance with The Data Protection Act 2018.

Confidentiality

​

Penny the Bee will not at any time hereafter use or disclose to any person, except as may be required by law or any legal or regulatory authority this Agreement or any confidential information concerning the Customer, except as described in the privacy policy here. 

 

Non-edible items

 

Cakes may contain non-edible items such as ribbons, dowels, brooches, modelling figures, flower wires, etc. These items must be removed before servings and Penny the Bee accepts no responsibility for any harm these might cause. Important information about in-edible materials is provided with all cake orders. You accept the responsibility to notify your guests and any involved parties of all the information given in the Important Information sheet provided, as well as making sure that small parts included in your cake are not given to young children who may suffocate.

Storage

​

Penny the Bee is unable to accept liability for any deterioration of the product due to incorrect storage of any left-over cakes after the event date.

 

Additional Information

 

From time to time certain materials for cakes become unavailable, or are substituted by new ones from Penny the Bee's suppliers. This is completely out of Penny the Bee's control.

Penny the Bee will do her best to re-design a cake that reflects the original design as closely as possible.

Penny the Bee reserves the right to replace parts of equal or better quality without consultation, however Penny the Bee will try to contact you to advise you regarding the changes.

Performance

​

The performance of this agreement is subject to the absence of force majeure events. 

Event of Force Majeure means any circumstance not within the reasonable control of Penny the Bee, but only if and to the extent that such circumstance materially and adversely affects the ability of Penny the Bee to perform its obligations under this Agreement and could not reasonably have been foreseen or provided against.

​

Events of Force Majeure shall include, but not limited to:

- fire, earthquakes, floods or such other extreme weather or environmental conditions, other natural calamities and Acts of God;

- explosion, accident, breakage of equipment;

- strikes;

- illness.
